Default Rental Agreement

This agreement is made between, the owner of the property located at the address listed on Beisee (the “Landlord”), and [Tenant’s name(s) as on Booking form/or other type of notice], the renter(s) (the “Tenant”).

The Landlord agrees to rent to the Tenant the furnished apartment located at [the address listed on Beisee] (the “Property”) for the dates of [rental start date] to [rental end date] for the purpose of [vacation, holiday, etc] (the “Rental Period”).

The Landlord affirms that they hold all rights to rent the Property and that it shall be made available to the Tenant in good condition, including all furnishings, equipment, and amenities advertised.

The Tenant agrees to abide by all rules and regulations for use of the Property set forth in this agreement and to treat the Property with care, leaving it in the same condition as at the beginning of the Rental Period.

The Tenant acknowledges this is a short-term rental not subject to tenant protection laws. The Tenant waives all rights under such laws for the duration of the Rental Period.

By completing a booking through Beisee’s platforms; Website, Email, Phone, or other means.

The Landlord and Tenant agree to the terms outlined in this Agreement, and the following terms and conditions shall govern their relationship:

The preamble and appendices herein are integral to and enforceable under this Agreement. Any breach thereof constitutes breach of contract.

The Tenants acknowledge inspecting the Premises and finding it suitable for habitation as-is, fully furnished and equipped. The Tenants desire to rent it in its present condition and configuration. 

This Agreement represents the Parties’ complete understanding, superseding all prior representations. Modifications require mutual written consent. Otherwise, this original document governs.

The Premises shall house the Tenants and approved occupants only, barring written consent.

The Tenants shall occupy the Premises for the term and rent stated in the booking form.

Rent is payable:

– 15% upon signing this Agreement as additional security; 

– Balance upon move-in and verifying beds, linens, and condition.

If the listing showed air conditioning but the Landlord failed to maintain operable units, the Tenants may repair or rent portable units at the Landlord’s expense.

If the above remedies were not available, the Tenants are entitled to a 20% nightly rent reduction for complete AC failure, 10% for living/bedroom failure, and 5% per non-working children’s room unit.

Extension of Rental Stay

If the tenant wishes to extend their stay beyond the original rental period, they must consult with the landlord in advance. If the landlord agrees to an extension, the nightly rate will remain the same as previously agreed upon, unless a new rate is mutually agreed upon. If the tenant extends their stay without the landlord’s consent, the nightly rate will be increased by 50% of the original rate for each additional night.

Cleaning

The landlord agrees to provide a clean and tidy home when you move in. In return, the tenant must leave the property in the same condition as when originally received. If any rooms require extra cleaning after you move out, there will be a $50 USD fee charged per room.

Lost property

Any item that is left after the agread retal period, knowingly or unknowingly, is considered to be gifted to the owner of the apartment. subject to that, that the item is not claimed within 30 days, If the item is claimed within 30 days, it must be returned to its original owner.

Remedies

If the apartment was advertised as having air conditioning, the tenant may repair or rent portable air conditioners at the landlord’s expense. If repairing or renting air conditioners is not possible, the rent will be reduced by 20% per night if none of the units work, 10% if the living room or bedroom unit does not work, or 5% if a child’s bedroom unit does not work.

If the landlord gave the tenant sufficient advance notice that the air conditioning units were not working and the tenant had previously agreed to this, then the remedy in the paragraph above will be waived.

Regarding cleanliness, the parties agree that a $50 cleaning fee per room will be deducted from the rental payment or paid as compensation if one or more rooms are found to be dirty.

Obligations and Limitations

During your stay, tenant should treat the property with the care you would your own. Please avoid any damage to the rental or disturbance to neighbors. Upon departure, we request that you vacate the premises on time, removing all guests and belongings. A late check-out fee of 1/10th the rental rate per hour will apply. 

Damage

Tenant is responsible for covering any repair costs for damage to the rental or furnishings, whether caused directly or indirectly by you or your guests. This includes full replacement value for any items that cannot be repaired. Unauthorized extra guests will incur a $50 USD per day fee.

The following rules should be discussed if applicable. Otherwise, the default policies will apply:

– Use of salt, Grape juice, oil, soap, paracetamol, etc. [On default, this is included].

– Use of some toys /games /books, and blankets for cold nights. [On default, this is included].

– Space made in cupboards.

Cancellation Policy:

If the tenant cancels the reservation without arranging for a replacement tenant, the cancellation fee is:

– Up to 1 week before check-in: 15% of total rental cost

– Up to 48 hours before check-in: 50% of total rental cost 

– Up to 24 hours before check-in: 75% of total rental cost

– Within 24 hours of check-in: Full rental cost (100%) 

If the landlord cancels the reservation without arranging an alternative apartment, the landlord must:

– Fully refund the renter’s payment

– Pay a cancellation compensation to the tenant:

   – Up to 1 week before check-in: 10% of total rental cost

   – Up to 48 hours before check-in: 20% of total rental cost

   – Up to 24 hours before check-in: 30% of total rental cost 

   – Within 24 hours of check-in: 40% of total rental cost

If the tenant or landlord must cancel the apartment rental due to unforeseen extraordinary circumstances like hospitalization, emergency room visit, premature birth, bereavement, or detention, the lease will be terminated without penalty to either party. If the cancellation is due to extraordinary circumstances on the landlord’s part, the landlord will refund the tenant’s full payment.

In case of a cancellation by the landlord, Beisee will make reasonable efforts to arrange an alternative apartment given the situation.

If no alternative apartment can be found, Beisee will refund the payment it received to the tenant, minus credit card fees. The landlord will also refund the tenant’s full payment.

If the cancellation is due to extraordinary circumstances on the tenant’s part, and the tenant has paid more than 10% already, the balance will be refunded to the tenant.

Everything in this agreement, including all appendices, is entered into wholeheartedly, willingly, and expediently by the parties. All notices are cancelled, witnesses regarding notice are disqualified, and nothing shall invalidate this agreement due to deficiencies, redundancies, erasures, or obfuscations. The parties have undertaken all promises and agreements here within a binding court, in the most beneficial way, accepting the methods of arbiters who believe obligations regarding property are valid even lacking substance, and who have waived any claims of Kim Li against this contract’s terms. All terms and conditions have been established at an honored Beith Din, without any Asmachte, and are fully valid and binding.
